  1. data protection during applications and the application process
The data controller collects and processes the personal data of applicants for the purpose of handling the application procedure. The processing may also take place electronically. This is particularly the case if an applicant submits relevant application documents to the controller by electronic means, for example by e-mail or via a web form located on the website. If the controller concludes an employment contract with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If the controller does not conclude an employment contract with the applicant, the application documents will be automatically deleted two months after notification of the rejection decision, provided that no other legitimate interests of the controller conflict with such deletion. Other legitimate interest in this sense is, for example, a duty to provide evidence in proceedings under the General Equal Treatment Act (AGG).
  1. privacy policy on the use and application of AddThis
The controller has integrated components of the company AddThis on this website. AddThis is a so-called bookmarking provider. The service enables a simplified bookmarking of Internet pages via buttons. By moving the mouse over the AddThis component or clicking on it, a list of bookmarking and sharing services is displayed. AddThis is used on more than 15 million websites, and the buttons are displayed more than 20 billion times a year, according to the operating company.

The operating company of AddThis is AddThis, Inc. 1595 Spring Hill Road, Suite 300, Vienna, VA 22182, USA.

Each time one of the individual pages of this website operated by the data controller is called up and on which an AddThis component has been integrated, the internet browser on the information technology system of the data subject is automatically prompted by the respective AddThis component to download data from the website www.addthis.com. The data subject’s internet browser is automatically prompted by the respective AddThis component to download data from the website. As part of this technical process, AddThis receives knowledge about the visit and which specific individual page of this website is used by the information technology system used by the data subject. Furthermore, AddThis obtains knowledge of the IP address assigned by the Internet service provider (ISP) of the computer system used by the data subject, the browser type, the browser language, the Internet page accessed before our Internet page, the date and the time of the visit to our Internet page. AddThis uses this data to create anonymized user profiles. The data and information transmitted to AddThis in this way enable AddThis itself and the companies associated with AddThis or its partner companies to target visitors to the websites of the controller with personalized and interest-based advertising.

AddThis displays personalized and interest-based advertising based on a cookie set by the company. This cookie analyzes the individual surfing behavior of the computer system used by the data subject. The cookie stores the visits to Internet pages originating from the computer system.

The data subject can prevent the setting of cookies by our website, as already described above, at any time by means of an appropriate setting of the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent AddThis from setting a cookie on the information technology system of the data subject. In addition, cookies already set by AddThis can be deleted at any time via an internet browser or other software programs.

The data subject also has the option to permanently object to the processing of personal data by AddThis. To do so, the data subject must press the opt-out button under the link http://www.addthis.com/privacy/opt-out, which sets an opt-out cookie. The opt-out cookie set with the objection, is stored on the information technology system used by the data subject. If the cookies on the system of the data subject are deleted after an objection, the data subject must call up the link again and set a new opt-out cookie.

However, with the setting of the opt-out cookie, there is the possibility that the internet pages of the controller are no longer fully usable for the data subject.

The applicable data protection provisions of AddThis can be found at http://www.addthis.com/privacy/privacy-policy.

  1. privacy policy on the use and application of Adobe Analytics (Omniture) / Adobe Marketing Cloud
The controller has integrated components of the company Adobe on this website. Adobe Analytics (Omniture) or the Adobe Marketing Cloud (hereinafter referred to as “Omniture”) is a tool that enables more efficient online marketing as well as web analysis. Omniture is a part of the Adobe Marketing Cloud. Adobe Marketing Cloud enables real-time analytics of website visitor traffic. The real-time analytics include project reports and allow ad-hoc analysis of website visitors. Customer interactions are presented in a way that gives the controller a better view of the online activities of the users of that website by displaying the data in simple and interactive dashboards and turning it into reports. This enables the Controller to receive real-time information and to identify problems that may arise more quickly.

The operator of these services is Adobe Systems Software Ireland Limited, 4-6 Riverwalk, Citywest Business Campus, Dublin 24, Republic of Ireland.

Omniture sets a cookie on the information technology system of the data subject (cookies have already been explained in advance; the corresponding information can be found above). The controller ensures through a server setting that the tracking data records transmitted to the Adobe data center are anonymized before geolocation. Anonymization is implemented by replacing the last part of the IP address. The controller has implemented server-side settings that anonymize the data subject’s IP address independently before any respective processing for geolocation and reach measurement. Adobe will, on behalf of the controller, use the data and information obtained via our website to evaluate the user behavior of the data subject. Furthermore, Adobe will use the data to generate reports on user activity on our behalf and to provide other services for our company in connection with the use of our website. The IP address of the data subject will not be merged with other personal data by Adobe.

The data subject can prevent the setting of cookies by our website, as already described above, at any time by means of an appropriate setting of the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Omniture from setting a cookie on the information technology system of the data subject. In addition, the cookies already set by Omniture can be deleted at any time via an Internet browser or other software programs.

Furthermore, the data subject has the opportunity to object to and prevent the collection of data generated by the Adobe cookie and related to a use of this website, as well as the processing of such data by Adobe. To do so, the data subject must press the unsubscribe button under the link http://www.adobe.com/de/privacy/opt-out.html, which sets an opt-out cookie. The opt-out cookie set with the objection is stored on the information technology system used by the data subject. If the cookies on the system of the data subject are deleted after an objection, the data subject must call up the link again and set a new opt-out cookie.

However, with the setting of the opt-out cookie, there is the possibility that the internet pages of the controller are no longer fully usable for the data subject.

The applicable Adobe privacy policy can be found at http://www.adobe.com/de/privacy.html.

  1. data protection provisions on the use and application of etracker
The controller has integrated components of the company etracker on this website. Etracker is a web analysis service. Web analysis is the collection, compilation and evaluation of data about the behavior of visitors to websites. Among other things, a web analysis service collects data about the website from which a data subject has accessed a website (so-called referrers), which sub-pages of the website have been accessed or how often and for how long a sub-page has been viewed. A web analysis is mainly used to optimize a website and for cost-benefit analysis of internet advertising.

The operating company of etracker is etracker GmbH, Erste Brunnenstraße 1, 20459 Hamburg, Germany.

Etracker sets a cookie on the information technology system of the data subject. What cookies are has already been explained above. Each time one of the individual pages of this website operated by the data controller is called up and on which an etracker component has been integrated, the internet browser on the information technology system of the data subject is automatically caused by the respective etracker component to transmit data to etracker for marketing and optimization purposes. As part of this technical process, etracker obtains knowledge of data that is subsequently used to create pseudonymous usage profiles. The usage profiles obtained in this way are used to analyze the behavior of the data subject who has accessed the website of the controller and are evaluated with the aim of improving and optimizing the website. The data collected via the etracker component will not be used to identify the data subject without first obtaining the separate and explicit consent of the data subject. This data will not be merged with personal data or with other data containing the same pseudonym.

The data subject can prevent the setting of cookies by our website, as already described above, at any time by means of an appropriate setting of the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent etracker from setting a cookie on the information technology system of the data subject. In addition, cookies already set by etracker can be deleted at any time via the Internet browser or other software programs.

Furthermore, the data subject has the option to object to the collection of data generated by the etracker cookie and related to a use of this website as well as to the processing of this data by etracker and to prevent such processing. To do this, the data subject must press the set cookie button under the link http://www.etracker.de/privacy?et=V23Jbb, which sets an opt-out cookie.

The applicable data protection provisions of etracker can be found at https://www.etracker.com/de/datenschutz.html.

  1. privacy policy on the use and application of Facebook
The controller has integrated components of the company Facebook on this website. Facebook is a social network.

A social network is a social meeting place operated on the Internet, an online community that generally allows users to communicate with each other and interact in virtual space. A social network can serve as a platform for sharing opinions and experiences or enables the Internet community to provide personal or company-related information. Among other things, Facebook enables users of the social network to create private profiles, upload photos and network via friend requests.

The operating company of Facebook is Facebook, Inc, 1 Hacker Way, Menlo Park, CA 94025, USA. The controller of personal data, if a data subject lives outside the USA or Canada, is Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Each time one of the individual pages of this website operated by the data controller is called up and on which a Facebook component (Facebook plug-in) has been integrated, the Internet browser on the information technology system of the data subject is automatically caused by the respective Facebook component to download a representation of the corresponding Facebook component from Facebook. A complete overview of all Facebook plug-ins can be found at https://developers.facebook.com/docs/plugins/?locale=de_DE. Within the scope of this technical procedure, Facebook receives knowledge of which specific sub-page of our website is visited by the data subject.

If the data subject is logged in to Facebook at the same time, Facebook recognizes which specific sub-page of our website the data subject is visiting each time the data subject calls up our website and for the entire duration of the respective stay on our website. This information is collected by the Facebook component and assigned by Facebook to the respective Facebook account of the data subject. If the data subject activates one of the Facebook buttons integrated on our website, for example the “Like” button, or if the data subject makes a comment, Facebook assigns this information to the personal Facebook user account of the data subject and stores this personal data.

Facebook always receives information via the Facebook component that the data subject has visited our website if the data subject is simultaneously logged into Facebook at the time of calling up our website; this takes place regardless of whether the data subject clicks on the Facebook component or not. If the data subject does not want this information to be transmitted to Facebook, he or she can prevent the transmission by logging out of his or her Facebook account before accessing our website.

The data policy published by Facebook, which can be accessed at https://de-de.facebook.com/about/privacy/, provides information about the collection, processing and use of personal data by Facebook. It also explains which setting options Facebook offers to protect the privacy of the data subject. In addition, various applications are available that make it possible to suppress data transmission to Facebook. Such applications can be used by the data subject to suppress data transmission to Facebook.

  1. Data protection regulations for the use of advertising networks.

17.1 Data protection regulations for the application and use of Google AdSense
The person responsible for processing has integrated Google AdSense on this website. Google AdSense is an online service that enables advertising to be placed on third-party sites. Google AdSense is based on an algorithm that selects the advertisements displayed on third-party sites that match the content of the respective third-party site. Google AdSense allows interest-based targeting of the Internet user, which is implemented by generating individual user profiles.

The operating company of the Google AdSense component is Alphabet Inc., 1600 Amphitheater Pkwy, Mountain View, CA 94043-1351, USA.

The purpose of the Google AdSense component is the integration of advertisements on our website. Google AdSense places a cookie on the information technology system of the person concerned. What cookies are has already been explained above. By setting the cookie, Alphabet Inc. is enabled to analyze the use of our website. Each time one of the individual pages of this website is called up, which is operated by the person responsible for processing and on which a Google AdSense component has been integrated, the Internet browser on the information technology system of the person concerned is automatically activated by the respective Google AdSense component to transmit data to Alphabet Inc. for the purpose of online advertising and the settlement of commissions.

The person concerned can prevent the setting of cookies by our website, as already described above, at any time by means of a corresponding setting in the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Alphabet Inc. from setting a cookie on the information technology system of the person concerned. In addition, a cookie already set by Alphabet Inc. can be deleted at any time via the Internet browser or other software programs.

Google AdSense also uses so-called tracking pixels. A tracking pixel is a miniature graphic that is embedded in websites to enable log file recording and log file analysis, which allows a statistical evaluation to be carried out. Based on the embedded tracking pixel, Alphabet Inc. can see if and when a website was opened by a data subject and which links were clicked on by data subjects. Tracking pixels are used, among other things, to evaluate the flow of visitors to a website.

Personal data and information, which also includes the IP address and is necessary for the collection and billing of the advertisements displayed, is transmitted to Alphabet Inc. in the United States of America via Google AdSense. This personal data is stored and processed in the United States of America. Alphabet Inc. may pass on this personal data collected via the technical process to third parties.

Google AdSense is explained in more detail under this link https://www.google.de/intl/de/adsense/start/.

17.2 Notes on integrating blogfoster Insights into our blog:

This website uses blogfoster Insights, an analysis tool from blogfoster GmbH, Mehringdamm 34, on the basis of our legitimate interests (ie interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 Para. 1 lit. f. However, blogfoster Insights uses cookies, which are stored on the user’s computer and which enable an analysis of the use of this online offer by the user. Pseudonymous user profiles can be created from the processed data.

The information generated by the cookie about your use of this online offer is stored on blogfoster GmbH servers. There is a contract for data processing with blogfoster GmbH.

17.4 Use of online systems for integration into the website

17.4.1 Use of webmart online systems for integration into the website.
WebMart offers components such as a newsletter, shop system, shopping cart system, event calendar, form mail, and guest book.

When registering with WebMart, WebMart requires your email address and a freely selectable login name (WebMartID). As soon as you top up your WebMart credit, we need additional data such as first name, surname and address for invoicing.

WebMart only uses this master data for invoicing. WebMart never gives them to third parties. You can use your transaction list to see what changes have been made to your WebMart account. Examples:

recharge credit
Changes to master data
Delete a tool
Sending a newsletter
Various payment options are available when topping up your WebMart credit. WebMart does not store credit card numbers. Since these are processed via the external service provider Stripe (stripe.com), WebMart does not receive this data either. When payment is received on the Webmart bank, PayPal or credit card account, conclusions can of course be drawn about your WebMart account. This is necessary in order to be able to allocate the amount to your WebMart account. None of this data is used for any other purpose. A deposit into your WebMart account is always done manually by you and never automatically.

17.4.1.1 Wemart Newsletters

The WebMart newsletter is processed via a double opt-in . This means that newsletter subscribers only become subscribers after clicking on the link in a confirmation email. When you click on the confirmation link, a time stamp is entered. The second way to add email addresses as subscribers is to add them manually in the newsletter administration. The WebMart customer should consent to these addresses (e.g. if the addresses are transferred from a shop or other newsletter system). It is your responsibility to ensure that this consent is obtained. When adding the email addresses, a time stamp is used to indicate when this happened.

Each newsletter contains an individual link for each subscriber, which can be used to unsubscribe from the newsletter. This cannot be deactivated in the newsletter settings either. As soon as a subscriber has unsubscribed, he is listed in the Robinson list. He could only be made a subscriber again through manual activation (by clicking on the link in a new confirmation email).

An export of the subscriber and Robinsons list is only possible in the WebMart newsletter administration and is only sent to the sender address of the newsletter.

WebMart does not use email addresses from subscribers, sender addresses, etc. for its own or other purposes and never passes them on to third parties.

Google reCAPTCHA is used on the opt-in page. See point “reCAPTCHA”.

open rate

Newsletters that are sent in HTML format contain a so-called “web beacon”, which is a one-pixel image. When the newsletter is opened, the one-pixel image is also called up. We receive the assignment to the newsletter sent and the subscriber reached.

For technical reasons, this information can be assigned to the individual newsletter recipients. However, it is not our aim to monitor individual users.

Information on the browser, system used, IP addresses, access times, etc. is not collected. The statistical surveys only include determining whether a subscriber has opened a newsletter. This is displayed to the newsletter customer (sender) in total as the open rate.

click rate

Newsletter articles can be provided with further (external) links whose clicks are counted for statistics (number of clicks). In this case, the links are directed via an intermediate page that counts the clicks on the link. No other data (IP addresses, access times, etc.) are stored or used.

The clicks cannot be attributed to the subscribers. The clicks are only counted in total per article. It cannot be determined which subscriber clicked which article.

17.4.2 Counter-go.de counter
The counter forwards information such as IP number and browser to counter-go.de for statistical
purposes. 1 is counted up per different user.

The person responsible for processing has integrated the Google Analytics component (with anonymization function) on this website. Google Analytics is a web analytics service. Web analysis is the collection, collection and evaluation of data on the behavior of visitors to websites. A web analysis service collects, among other things, data about the website from which a person concerned came to a website (so-called referrer), which subpages of the website were accessed or how often and for how long a subpage was viewed. A web analysis is mainly used to optimize a website and for the cost-benefit analysis of internet advertising.

The operating company of the Google Analytics component is Google Inc., 1600 Amphitheater Pkwy, Mountain View, CA 94043-1351, USA.

The person responsible for processing uses the addition “_gat._anonymizeIp” for the web analysis via Google Analytics. By means of this addition, the IP address of the Internet connection of the data subject is shortened and anonymized by Google if our Internet pages are accessed from a member state of the European Union or from another state party to the Agreement on the European Economic Area.

The purpose of the Google Analytics component is to analyze visitor flows on our website. Google uses the data and information obtained, among other things, to evaluate the use of our website, to compile online reports for us that show the activities on our website, and to provide other services related to the use of our website.

Google Analytics places a cookie on the information technology system of the data subject. What cookies are has already been explained above. By setting the cookie, Google is able to analyze the use of our website. Each time one of the individual pages of this website is called up, which is operated by the person responsible for processing and on which a Google Analytics component has been integrated, the Internet browser on the information technology system of the person concerned is automatically activated by the respective Google Analytics component to transmit data to Google for online analysis. As part of this technical process, Google gains knowledge of personal data, such as the IP address of the person concerned, which Google uses, among other things,

The cookie is used to store personal information, such as access time, the location from which access was made and the frequency of visits to our website by the person concerned. Each time you visit our website, this personal data, including the IP address of the Internet connection used by the person concerned, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America. Google may pass on this personal data collected via the technical process to third parties.

The person concerned can prevent the setting of cookies by our website, as already described above, at any time by means of a corresponding setting in the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Google from setting a cookie on the information technology system of the person concerned. 1. Data protection regulations for the application and use of Google Remarketing
The person responsible for processing has integrated Google Remarketing services on this website. Google Remarketing is a Google AdWords feature that allows a company to serve ads to Internet users who have previously visited the company’s website. The integration of Google Remarketing therefore allows a company to create user-related advertising and consequently to display interest-relevant advertisements to the Internet user.

The operator of the Google Remarketing services is Google Inc., 1600 Amphitheater Pkwy, Mountain View, CA 94043-1351, USA.

The purpose of Google Remarketing is to display interest-based advertising. Google Remarketing enables us to display advertisements via the Google advertising network or to have them displayed on other websites, which are tailored to the individual needs and interests of Internet users.

Google Remarketing sets a cookie on the information technology system of the data subject. What cookies are has already been explained above. With the setting of the cookie, Google is able to recognize the visitor to our website if he or she subsequently calls up websites that are also members of the Google advertising network. Each time a website is accessed on which the Google Remarketing service has been integrated, the Internet browser of the person concerned automatically identifies itself to Google. As part of this technical process, Google gains knowledge of personal data, such as the IP address or the surfing behavior of the user, which Google uses, among other things, to display interest-based advertising.

The cookie is used to store personal information, such as the Internet pages visited by the person concerned. Accordingly, each time you visit our website, personal data, including the IP address of the Internet connection used by the person concerned, is transmitted to Google in the United States of America.

In addition, a cookie already set by Google Analytics can be deleted at any time via the Internet browser or other software programs.

Furthermore, the data subject has the option of objecting to interest-based advertising by Google. To do this, the person concerned must call up the link www.google.de/settings/ads from each of the Internet browsers they use and make the desired settings there.

Further information and Google’s applicable data protection regulations can be found at https://www.google.de/intl/de/policies/privacy/.

  1. Data protection regulations for the use of Google+
The person responsible for processing has integrated the Google+ button as a component on this website. Google+ is a
so-called social network. A social network is a social meeting place operated on the Internet, an online community that
usually enables users to communicate with one another and to interact in virtual space. A social network can serve as a platform
for exchanging opinions and experiences, or it allows the Internet community to
provide personal or company-related information. Google+ enables users of the social network to create private profiles and upload photos, among other things
    and networking via friend requests.

The operating company of Google+ is Google Inc., 1600 Amphitheater Pkwy, Mountain View, CA 94043-1351, USA.
Further information and Google’s applicable data protection regulations can be found at https://www.google.de/intl/de/policies/privacy/. Further information from Google on the Google +1 button can be found at https://developers.google.com/+/web/buttons-policy
.

Google closed the social network for private users on April 2nd, 2019.

  1. Data protection regulations for the deployment and use of Google AdWords
The person responsible for processing has integrated Google AdWords on this website. Google AdWords is an internet advertising service that allows advertisers to place ads in both Google’s search engine results and the Google advertising network. Google AdWords allows an advertiser to pre-define certain keywords that will be used to display an ad in Google’s search engine results only when the user uses the search engine to retrieve a keyword-related search result. In the Google advertising network, the ads are distributed to topic-relevant websites using an automatic algorithm and taking into account the previously defined keywords.

The operator of the Google AdWords services is Google Inc., 1600 Amphitheater Pkwy, Mountain View, CA 94043-1351, USA.

The purpose of Google AdWords is to promote our website by displaying interest-related advertising on the websites of third-party companies and in the search engine results of the Google search engine and displaying third-party advertising on our website.

If a person concerned reaches our website via a Google ad, a so-called conversion cookie is stored on the information technology system of the person concerned by Google. What cookies are has already been explained above. A conversion cookie loses its validity after thirty days and is not used to identify the person concerned. If the cookie has not yet expired, the conversion cookie is used to determine whether certain sub-pages, such as the shopping cart from an online shop system, were accessed on our website. The conversion cookie enables both us and Google to understand whether a person who came to our website via an AdWords ad generated revenue, i.e. completed or canceled a purchase.

The data and information collected through the use of the conversion cookie are used by Google to create visit statistics for our website. In turn, we use these visit statistics to determine the total number of users who were referred to us via AdWords ads, i.e. to determine the success or failure of the respective AdWords ad and to optimize our AdWords ads for the future . Neither our company nor other Google AdWords advertisers receive information from Google that could be used to identify the person concerned.

The conversion cookie is used to store personal information, such as the website visited by the person concerned. Accordingly, each time you visit our website, personal data, including the IP address of the Internet connection used by the person concerned, is transmitted to Google in the United States of America.

Such a setting of the Internet browser used would also prevent Google from setting a conversion cookie on the information technology system of the person concerned. In addition, a cookie already set by Google AdWords can be deleted at any time via the Internet browser or other software programs.

Security plugins are not mentioned in detail in the online version, so as not to encourage hacker attacks. According to the GDPR, our interest in the security of our site outweighs the customer’s data protection information obligation.
– In order to be able to block attacks through automatic logins, it is necessary
to save the IP address of the user logging in on the login page. If the login is correct, no entries appear in the WordPress dashboard,
failed logins are logged there. After the 5th failed login, the administrator receives an e-mail that the corresponding IP has been blocked. Limit Login Attempts by Johan Eenfeldt is one of the plugins.

PayPal may pass on the personal data to affiliated companies and service providers or subcontractors insofar as this is necessary to fulfill the contractual obligations or the data is to be processed in the order.

The data subject has the option of withdrawing their consent to the handling of personal data from PayPal at any time. A revocation does not affect personal data that must be processed, used or transmitted for (contractual) payment processing.

PayPal’s applicable data protection regulations can be found at https://www.paypal.com/de/webapps/mpp/ua/privacy-full.

32. Payment method: data protection regulations for immediate transfer as a payment method
The person responsible for processing has integrated components of immediate transfer on this website. Sofortüberweisung is a payment service that enables cashless payment for products and services on the Internet. Sofortüberweisung represents a technical procedure through which the online retailer immediately receives a payment confirmation. In this way, a retailer is able to deliver goods, services or downloads to the customer immediately after the order has been placed.

The operating company of Sofortüberweisung is SOFORT GmbH, Fußbergstraße 1, 82131 Gauting, Germany.

If the person concerned selects “Sofortüberweisung” as a payment option during the ordering process in our online shop, the data of the person concerned is automatically transmitted to Sofortüberweisung. By selecting this payment option, the person concerned agrees to the transfer of personal data required for payment processing.

When making a purchase via Sofortüberweisung, the buyer transmits the PIN and TAN to Sofort GmbH. Sofortüberweisung then carries out a transfer to the online retailer after a technical check of the account balance and retrieval of further data to check the account funds. The execution of the financial transaction is then automatically communicated to the online retailer.

The personal data exchanged with Sofortüberweisung is first name, last name, address, email address, IP address, telephone number, mobile phone number or other data required for payment processing. The transmission of the data is intended for payment processing and fraud prevention. The person responsible for processing will also transmit other personal data to Sofortüberweisung if there is a legitimate interest in the transmission. The personal data exchanged between Sofortüberweisung and the person responsible for processing may be transmitted by Sofortüberweisung to credit agencies. The purpose of this transmission is to check identity and creditworthiness.

Sofortüberweisung may pass on the personal data to affiliated companies and service providers or subcontractors, insofar as this is necessary to fulfill the contractual obligations or the data is to be processed in the order.

The person concerned has the option to revoke their consent to the handling of personal data at any time. A revocation does not affect personal data that must be processed, used or transmitted for (contractual) payment processing.

The applicable data protection regulations of Sofortüberweisung can be accessed at https://www.sofort.com/ger-DE/datenschutzerklaerung-sofort-gmbh/.

33. Payment type transfer
In the case of transfers, the sending and receiving bank are always given the following data:
name and address of the sending and receiving bank, as well as account number, sort code,
BIC / SWIFT-BIC and IBAN of the sending and receiving bank. Then there is the amount of money and purpose. The data may also be visible to intermediate stations and to IT service providers and bank employees. The data can also be viewed by tax offices and customs if, for example, there is a suspicion of undeclared work or illegal illegal money transfers.
For amounts over EUR 100, a copy of the payment receipt is usually recorded in accounting.

If you object to the transfer of data, all transfer transactions from bank transfer to instant transfer to PayPal are not possible. Then only cash payment in advance or upon collection is possible.

34. Legal basis of processing
Art. 6 I lit. a DS-GVO serves our company as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary to fulfill a contract to which the data subject is party, as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of another service or consideration, the processing is based on Art. 6 I lit. b GDPR. The same applies to such processing operations that are necessary to carry out pre-contractual measures, for example in the case of inquiries about our products or services. If our company is subject to a legal obligation which requires the processing of personal data, such as the fulfillment of tax obligations, the processing is based on Art. 6 I lit. c GDPR. In rare cases, the processing of personal data could become necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance data or other vital information would have to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6 I lit. d GDPR. Ultimately, processing operations could be based on Art. 6 I lit. f DS-GVO. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests, fundamental rights and fundamental freedoms of the person concerned do not prevail. Such processing operations are permitted to us in particular because they have been specifically mentioned by the European legislator. In this respect, he took the view that a legitimate interest could be assumed if the data subject is a customer of the person responsible (recital 47 sentence 2 DS-GVO). if the processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests, fundamental rights and fundamental freedoms of the person concerned do not prevail. Such processing operations are permitted to us in particular because they have been specifically mentioned by the European legislator. In this respect, he took the view that a legitimate interest could be assumed if the data subject is a customer of the person responsible (recital 47 sentence 2 DS-GVO).

35. Legitimate interests in the processing pursued by the controller or a third party.
If the processing of personal data is based on Article 6 I lit. f GDPR, our legitimate interest is conducting our business for the benefit of all our employees and our shareholders.

36. Duration for which the personal data is stored
The criterion for the duration of the storage of personal data is the respective statutory retention period. After the deadline has expired, the corresponding data will be routinely deleted, provided that they are no longer required to fulfill the contract or to initiate a contract.

37. Statutory or contractual requirements for providing the personal data; Necessity for the conclusion of the contract; obligation of the data subject to provide the personal data; possible consequences of non-provision
We clarify that the provision of personal data is partly required by law (e.g. tax regulations) or can also result from contractual regulations (e.g. information on the contractual partner). Sometimes, in order to conclude a contract, it may be necessary for an affected person to provide us with personal data, which we must subsequently process. For example, the data subject is obliged to provide us with personal data if our company concludes a contract with them. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. Before personal data is provided by the data subject, the data subject must contact one of our employees.

38. Existence of automated decision -making
As a responsible company, we do not use automated decision-making or profiling.

39. Specifics of data recovery.
The customer allows AFD-PC-SERVICE.de Armin Fischer // Armin Fischer Services to copy data from a damaged or faulty hard drive, SD card, USB stick or from a data carrier threatened by data loss onto other data carriers used by us for all customers copy and temporarily store peripherally on computers.
In the case of operationally sensitive data, the customer must inform us in advance that it is sensitive company data. However, the customer must then also bear the costs for these data carriers or the costs for the use and wear and tear of this data rescue.
In the case of operationally sensitive and/or secret data, we offer, if the customer does not purchase the entire data carrier, that we delete the data by reformatting it several times.
Based on the American standard 7x overwrite.
Based on the German standard 34x overwriting.

In consultation with the customer, the data can also be handed over to a data recovery specialist such as Kroll Ontrack. After handover to the data rescuer, the conditions of this data rescuer apply.

Unless otherwise agreed, the data will be deleted by simply deleting the files from the hard drive and/or the data carriers no later than 2 weeks after the customer has given his OK.
If the retention period is longer, this is agreed with the customer.

The data recorded by customers is only accessible by employees of AFD-PC-SERVICE.de Armin Fischer / Armin Fischer dienstleistungen.

40. Peculiarities of remote maintenance
With remote maintenance, AFD-PC-SERVICE.de Armin Fischer // Armin Fischer Services can access data files and functions of the operating system, as if the service provider is on site.
As a rule, we use TeamViewer 11 for customer remote maintenance.
The customer is informed about fundamental risks prior to installation, so that
theoretically access by someone else would also be possible.
Functions with TeamViewer autostart when the computer is started with permanent access and a fixed password are only set up after consultation with the customer and in necessary cases, e.g. if the customer does not know how to operate the program and a considerable journey would be necessary and/or if several times Access to a customer computer is required per day.
Access via remote maintenance may also be necessary when purchasing office services from us.
TeamViewer has already taken steps to ensure that remote maintenance from the service provider, here AFD-PC-SERVICE.de Armin Fischer // Armin Fischer Services, can only connect user accounts with stored customer accounts on devices that have been confirmed by e-mail in advance.
In consultation with the customer, a group can also be set up where company
colleague diePCWerkstatt.de Marco Mueller can access.
Should a further service provider be added, this is only done after consultation with the customer.

41. Handing over a device with customer data to colleagues.
In consultation with the customer, devices can be sent to our business partners.
Devices are cell phones, smartphones with internal memory and MicroSD, tablets with internal memory and MicroSD, netbooks, notebooks, laptops and desktop PCs with hard drives or SSD. If the device is given to a colleague, the colleague’s data protection regulations apply from the moment the colleague accepts the device. If the device is picked up by us and by the customer

30. Data protection regulations for the deployment and use of ADITION
The person responsible for processing has integrated ADITION components on this website. ADITION is a data-based digital marketing provider that provides an advertising platform aimed at advertisers and online marketing agencies.

ADITION’s operating company is ADITION technologies AG, Oststraße 55, 40211 Düsseldorf, Germany.

The purpose of ADITION is the display of digital advertising material. ADITION sets a cookie on the information technology system of the data subject. What cookies are has already been explained above. ADITION does not store any personal data in the cookie. All information stored in the cookie is of a technical nature and makes it possible, among other things, to understand how often certain advertising media are displayed.

The person concerned can prevent the setting of cookies by our website, as already described above, at any time by means of a corresponding setting in the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent ADITION from setting a cookie on the information technology system of the person concerned. In addition, cookies already set by ADITION can be deleted at any time via an Internet browser or other software programs.

It is also possible to object to and prevent the collection of the data generated by the ADITION cookie relating to the use of this website and the processing of this data by ADITION. To do this, the person concerned must click on a link at https://www.adition.com/kontakt/datenschutz/, which sets an opt-out cookie. The opt-out cookie set with the objection is stored on the information technology system used by the person concerned. If the cookies on the data subject’s system are deleted after an objection, the data subject must call up the link again and set a new opt-out cookie.

With the setting of the opt-out cookie, however, there is the possibility that the website of the person responsible for processing can no longer be fully used by the person concerned.

ADITION’s applicable data protection regulations can be accessed at https://www.adition.com/kontakt/datenschutz/.

31. Payment method: data protection provisions for PayPal as a payment method.
The person responsible for processing has integrated PayPal components on this website. PayPal is an online payment service provider. Payments are processed via so-called PayPal accounts, which represent virtual private or business accounts. PayPal also offers the option of processing virtual payments via credit cards if a user does not have a PayPal account. A PayPal account is managed via an email address, which is why there is no classic account number. PayPal makes it possible to trigger online payments to third parties or to receive payments. PayPal also assumes trustee functions and offers buyer protection services.

The European operating company of PayPal is PayPal (Europe) S.à.rl & Cie. SCA, 22-24 Boulevard Royal, 2449 Luxembourg, Luxembourg.

If the data subject selects “PayPal” as the payment option during the ordering process in our online shop, the data of the data subject is automatically transmitted to PayPal. By selecting this payment option, the person concerned agrees to the transmission of personal data required for payment processing.

The personal data transmitted to PayPal is usually first name, last name, address, email address, IP address, telephone number, mobile phone number or other data required for payment processing. Personal data related to the respective order are also required to process the purchase contract.

The transmission of the data is intended for payment processing and fraud prevention. The person responsible for processing will transmit personal data to PayPal in particular if there is a legitimate interest in the transmission. The personal data exchanged between PayPal and the person responsible for processing may be transmitted by PayPal to credit agencies. The purpose of this transmission is to check identity and creditworthiness.

48. Unchangeable data backup
media For the purpose of data backup, we back up the accounting, balance sheet and invoices,
as well as the order tickets and service orders.
If customers previously wanted invoices with customer data and now want to forbid us to store their address data, this does not work anyway due to legal regulations and obligations to the tax office, for example.

Contacts can be deleted from Google, for example.
The basic data set can also be deleted from the hard disk at any time in the current year. We can therefore make targeted deletions.

If the customer also explicitly requests that his data be deleted from backup data carriers such as CD-Rs or DVD-Rs, then the data must be completely recompiled without his data and the original data carrier destroyed.
This may result in considerable effort for us. This may not be possible even free of charge and may be subject to additional costs.

DVD-Rs and CD-Rs with customer data are cut into at least 8 parts with scissors according to the pie principle so that the data can no longer be read before they are disposed of in accordance with disposal guidelines.

49. Data deletion on rewritable data carriers
When deleting data on a data carrier shared with data from other customers, we regularly delete it by deleting the table of contents.
This means that the data can
theoretically be restored until it is actually overwritten by the required storage space on the system.

a) hard drive.
According to the American standard, secure deletion would mean overwriting the hard disk 7 times.
According to the German standard, more than 35x is recommended.
Already with 1x overwriting the data of other customers would be gone.
The other customer data, i.e. up to more than 99%, would first have
to be backed up to another hard drive in order to be overwritten multiple times. Since the effort of data backup arises, which can take several hours to days, then the 2nd data carrier.
Mechanical hard drives are extremely stressed during these frequent overwriting processes,
the plate can become hot or be destroyed. Days of overwriting drives up the hours of operation, which in turn makes hardware destroyed blocks and sectors more and more likely. Standard hard drives are not designed for continuous operation, if they are overwritten for several days at a time, it is very likely that the data carrier is defective.
If you want that from us, you have to pay for the effort.

When disposing of or ensuring that data is definitely no longer used, we smash the hard drive with a hammer before it is sent for regular disposal.

Information on how a hard drive works , here: https://youtu.be/z95RIv00wJw .

b) SSD.
According to the American standard, secure deletion would be 7x overwriting of the SSD.
According to the German standard, more than 35x is recommended.

Already with 1x overwriting the data of other customers would be gone.
The other customer data, i.e. up to more than 99%, would first have
to be saved to another SSD or hard drive for multiple overwriting. Since the effort of data backup arises, which can take several hours to days, then the 2nd data carrier.
SSDs are extremely stressed with these frequent overwriting processes,
the disk can be destroyed. Days of overwriting drives up the operating hours, which in turn makes hardware-related flash cells destroyed by degeneration of the insulator layer more and more likely. A total of just over 3000 erase operations are possible for each flash cell.
If you want that from us, you have to pay for the effort

Data specified by the customer in advance as sensitive under data protection law will
not be stored by us on our data carriers or data carriers used together with other customer data, but on the customer’s data carriers.
If the customer does not have a data carrier, he can purchase a suitable one from us.

50. Data backup in medical practices, tax offices, law firms, etc.

In these sensitive data areas, we strive to secure the data on site at the customer’s, depending on the sensitivity of the data. We try to secure it on the same system with a live CD.
Ideally, the data does not leave the practice or law firm if the data is sensitive, but is stored on a second data carrier that remains in the practice or law firm.
If the hard disk is mechanically damaged, it may have to be sent to a data recovery specialist in a clean room laboratory.
If the computer has a defective mainboard, Windows may also have to be reinstalled
if the mainboard has a different chipset.
To do this, you would have to back up all the data and then play it back on the computer.
It is often more cost-effective to transfer the system to a new hard drive and get the missing data from the other hard drive. Sometimes a new computer is worth it.

51. Paper Documentation and Disposal

The paper documentation is kept in lockable rooms.
Paper documents from customers and business partners that are no longer required, along with their data, are shredded.

52. Storage of digital documents

a) Safekeeping of the digital documents
Most of the customer documentation is located on a computer at the business location,
as well as mirrored at Dropbox. The computer is in a lockable room.
The calculator is password protected.

b) System security: virus protection
The computer is protected against viruses and other malware by ESET InternetSecurity.
